These terms apply to your use of nivoxshop.com and to any order you place
with us. Please read them before ordering. Nothing in these terms affects
your statutory rights as a consumer.

HOW A CONTRACT IS FORMED

When you place an order you are making an offer to buy. We send an order
confirmation email acknowledging that we have received it. A contract is
formed when we dispatch your order and send you a dispatch confirmation.

If we cannot fulfil your order, we will tell you and refund any payment in
full.

PRICES AND PAYMENT

All prices are shown in pounds sterling and include applicable taxes where
these are charged. Delivery within the United Kingdom is free.

We take payment at the time you place your order. We accept the payment
methods shown at checkout.

We try to make sure all prices are correct. If we discover a genuine pricing
error before dispatch, we will contact you and give you the choice of
confirming your order at the correct price or cancelling for a full refund.
We will not simply charge you the higher amount.

PRODUCT INFORMATION

We describe our products as accurately as we can. Photographs and videos are
illustrative, and colours may appear differently on different screens.

Our products are consumer goods. The Nivox Nudge is a silent vibrating alarm
watch. It is not a medical device, it is not a sleep tracker, and it is not
intended to diagnose, treat or monitor any medical condition. It should not
be relied on where failing to wake would put you or anyone else at risk.

AVAILABILITY

All orders are subject to availability. If an item becomes unavailable after
you order, we will contact you and offer a replacement or a full refund.

AGE

You must be at least 18 years old to place an order.

USING THIS WEBSITE

You may use this website for lawful purposes only. You must not attempt to
gain unauthorised access to it, interfere with its operation, or use it in
any way that could damage or disrupt it.

INTELLECTUAL PROPERTY

The content of this website, including text, images, video and the Nivox
name, belongs to us or is used with permission. You may not copy or reuse it
commercially without our written consent.

OUR LIABILITY

We are responsible for loss or damage you suffer that is a foreseeable result
of us breaking these terms or failing to use reasonable care and skill.

We do not exclude or limit our liability in any way where it would be
unlawful to do so. This includes liability for death or personal injury
caused by our negligence, for fraud, and for any breach of your legal rights
in relation to the products, including the right to receive goods that are
of satisfactory quality, fit for purpose, as described and supplied with
reasonable care and skill.

We are not liable for business losses. Our products are supplied for domestic
and private use.

EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays or failures caused by events outside our
reasonable control, such as carrier disruption, customs delays, extreme
weather or industrial action. If such an event occurs we will contact you and
you may cancel your order for a full refund if the delay is substantial.

CHANGES TO THESE TERMS

We may update these terms from time to time. The terms that apply to your
order are those published on this website at the time you placed it.

COMPLAINTS

Email info@nivoxshop.com with "Complaint" in the subject line. We respond
within 5 working days.

GOVERNING LAW

These terms are governed by the law of England and Wales. If you are a
consumer resident elsewhere in the United Kingdom, you keep the benefit of
any mandatory protections of the law where you live, and you may bring
proceedings in your local courts.
